Limited Lifetime Warranty

The Phoenix Telescoping Flagpole comes with a Limited Lifetime Manufacturer Warranty covering design defects and normal wear and tear.

If the swivel rings or interlocking sleeves ever wear out, contact us for replacement parts.

Phoenix Flagpole Forever Warranty

This warranty is extended by the manufacturer, Phoenix Flagpoles, located at 41 W Hwy 14 #173, Spearfish, SD 57783, to you, the original purchaser of the Phoenix Telescoping Flagpole.

Your Phoenix Telescoping Flagpole is warranted to be free from defects in materials and workmanship for life to you, the original owner, when used as intended as a flagpole and provided the number and size of flags do not exceed the maximum specifications provided in this warranty.

Phoenix Flagpoles will replace any failed or damaged covered parts at no charge to you, excluding shipping and handling fees. If you choose to return your flagpole to Phoenix Flagpoles or Atlantic Flagpole, Inc., we will repair or replace the failed or damaged item at no cost for parts; however, you will be responsible for labor and shipping charges.

Warranty Exclusions

This warranty does not cover damage or defects caused by:

Warranty Registration

To activate your warranty, it must be registered within 90 days of purchase.

The Forever Lifetime Warranty does not extend to any free kit accessories, bundles, promotional products, prizes, flags, or any other items included at the time of purchase of the Phoenix Flagpole.

Some states do not permit limitations on how long an implied warranty lasts, nor the exclusion or limitation of incidental or consequential damages. You may wish to consult legal counsel familiar with the rights available to you in your area.

100 MPH Wind Guarantee

The 100 MPH Wind Guarantee applies to the bending or breakage of the aluminum tubing on the Phoenix Telescoping Flagpole and is in addition to the Limited Forever Warranty.

This guarantee is designed to protect the safety of the user and provide peace of mind by ensuring the flagpole is free from defects in manufacturing. The guarantee is subject to specific restrictions and protocols to ensure safe and proper use.

This Guarantee Is Valid Only When:

1. One flag, 4' x 6' or smaller, is attached to the Phoenix Flagpole.
2. No additional accessories are attached, including but not limited to solar lights, decorative toppers other than the standard 3" gold ball topper, or any other modifications that could affect the wind resistance of the flagpole.

What Is Covered

If bending or breakage occurs due to winds not exceeding 100 MPH, the guarantee covers the replacement of the damaged aluminum tubing.

What Is Not Covered

This guarantee does not cover damage caused by:

• Negligence
• Improper installation
• Accidental damage
• Intentional damage
• Failure to lower the flagpole during extreme weather conditions
• Acts of God, such as tornadoes, hurricanes, or other catastrophic events
• Shipping, handling, or labor costs associated with replacement

Owner Responsibility

It is the sole responsibility of the flagpole owner to:

• Monitor weather conditions in their area
• Remove all accessories and/or lower the flagpole during severe weather or wind events
• Lower the flagpole especially when winds are forecasted to exceed 100 MPH or are accompanied by other extreme conditions

Failure to follow these protocols will void the 100 MPH Wind Guarantee.

Additionally, the guarantee does not cover incidental or consequential damages resulting from improper use, accidental damage, intentional damage, or failure to follow the terms outlined above.

Proof and Investigation Requirements

To file a claim under the 100 MPH Wind Guarantee, the flagpole owner must provide:

• Proof of purchase
• Evidence supporting compliance with the terms of this guarantee
• Details of the conditions under which the damage occurred

Upon submission of the claim, an investigation will begin to determine the validity of the claim. Honoring the claim is at the sole discretion of the manufacturer, Phoenix Flagpoles, after the investigation is complete.

Replacement under this guarantee is limited to the aluminum tubing only and does not include shipping, handling, or labor costs associated with the replacement.

This guarantee is intended to protect the customer against defects in manufacturing and to ensure the safe and reliable use of the Phoenix Telescoping Flagpole.

Wind Resistance 100 MPH Guarantee Disclaimer and Warranty Terms

Wind Rating and Testing Standards

Phoenix Telescoping Flagpoles are tested to withstand wind gusts of up to 100 miles per hour, provided the following conditions are met:

• The flagpole is installed according to our official instructions.
• Only the included embroidered Premium Nylon U.S. flag is flown.
• A 3' x 5' flag is used with 15' flagpoles.
• A 4' x 6' flag is used with 20' and 25' flagpoles.
• The flagpole is used under normal weather conditions and is not subjected to excessive or sustained severe weather events.

Limitations and Owner Responsibility

Please note that wind resistance is influenced by many external factors beyond our control, and Atlantic Flag & Pole cannot verify the specific conditions under which any individual flagpole is being used.

These factors include, but are not limited to:

• Flying larger or heavier flags than the included Premium Nylon U.S. flag
• Flying multiple flags simultaneously
• Exposure to sustained winds as opposed to brief gusts
• Moisture exposure, including rain and snow, which increases flag weight
• Freezing temperatures, which may reduce the flexibility of aluminum materials
• Improper installation or any deviation from our provided instructions

Because these variables significantly impact performance, it is the sole responsibility of the flagpole owner to ensure proper care, usage, and installation.

Negligence, including failure to lower the flagpole during extreme weather conditions, may result in structural failure.

Limited Wind Resistance 100 MPH Guarantee and Replacement Policy

While structural failure is rare with our flagpoles, and even more uncommon to occur multiple times, we recognize that issues may arise.

To support our customers while preventing abuse of our policies, we offer the following:

• A limited 100 MPH wind guarantee covering the aluminum tube sections of the flagpole under the above-specified conditions.
• In the event of a qualifying failure, we may, at our sole discretion, provide a one-time replacement of the aluminum tube sections, requiring the customer to cover the cost of shipping.
• Additional replacements may also be considered under extenuating circumstances and under the same conditions, provided the customer agrees to pay for shipping.
